These Terms of Service govern your access to and use of the Mac Beach Studio website, online store, products, content, and related services.

By visiting the website, placing an order, creating an account, or otherwise using the website, you agree to these Terms of Service and to the Privacy Policy, Shipping Policy, and Return and Refund Policy posted on the website.

Products and presentation

Mac Beach Studio offers original photographic artworks produced to order as acrylic and aluminum metal prints.

Product photographs, digital previews, room mockups, and screen images are intended to represent the artwork and presentation as accurately as reasonably possible. Color, brightness, contrast, scale, reflectivity, and surface appearance may vary because of monitor settings, lighting conditions, production materials, and fabrication processes.

Minor variations in color, reflectivity, finish, mounting, or fabrication that are inherent to photographic printing and production are not considered defects.

Orders

All orders are subject to acceptance, product availability, production feasibility, payment authorization, and verification.

Mac Beach Studio may refuse or cancel an order because of:

  • Incorrect pricing or product information
  • Payment or fraud concerns
  • Production limitations
  • Inventory or material availability
  • Shipping restrictions
  • Technical errors
  • Suspected misuse of the website

If Mac Beach Studio cancels an order after payment has been collected, the amount paid for the canceled order will be refunded to the original payment method.

An order-confirmation email confirms receipt of the order but does not guarantee that production has begun or that the order has been finally accepted.

Prices and payment

Prices are listed in U.S. dollars unless otherwise stated.

Prices, editions, sizes, materials, availability, and product specifications may change without notice. Changes will not affect an order that has already been accepted, except where correction is required because of an obvious pricing, technical, or product-listing error.

Payment is collected through Shopify and its authorized payment processors. Mac Beach Studio does not directly store complete payment-card information.

Customers are responsible for providing complete and accurate billing, shipping, contact, and payment information.

Limited editions

Edition quantities are stated on the applicable product page.

Edition numbers apply separately to each listed size unless the product description expressly states otherwise. Availability may change as works are sold.

A Certificate of Authenticity identifies the artwork title, edition, and size. The certificate may be mailed separately from the finished print.

The purchase of an artwork does not transfer copyright, reproduction rights, licensing rights, or other intellectual-property rights.

Production and shipping

Each work is produced to order.

Production generally requires 3 to 5 business days. Shipping generally requires an additional 5 to 8 business days after production. These timeframes are estimates, not guarantees.

Seasonal demand, weather, carrier interruptions, production issues, oversized handling, address problems, and other circumstances outside Mac Beach Studio’s reasonable control may extend delivery time.

Shipping is currently available only to eligible addresses within the United States and only where a shipping option is offered at checkout.

Customers are responsible for providing a complete, accurate, and deliverable shipping address and a working telephone number where requested for delivery coordination.

Risk of loss and responsibility for delivery are subject to the applicable carrier’s tracking and delivery records, except where otherwise required by law.

Inspection, damage, and defects

Customers should inspect the package and artwork promptly upon delivery.

Claims involving shipping damage or a verified production defect must be submitted within 5 days of delivery and must include:

  • The order number
  • Clear photographs of the exterior packaging
  • Clear photographs of the interior packaging
  • Clear photographs of the artwork and reported issue
  • Any other information reasonably requested to evaluate the claim

Eligible claims will ordinarily be resolved by replacement with the same artwork, edition, material, and size.

Customers should retain all packaging until the claim has been resolved.

Returns and refunds

Because each artwork is produced to order and editions are limited, returns and exchanges based on preference, scale selection, color expectation, installation conditions, or change of mind are not accepted.

Refunds and replacements are governed by the Return and Refund Policy posted on the website.

Nothing in these Terms limits any non-waivable rights available under applicable consumer-protection law.

Installation and handling

Customers are responsible for evaluating the suitability of walls, anchors, fasteners, mounting surfaces, and installation conditions.

Any included hanging system must be installed appropriately for the wall construction, artwork weight, and site conditions.

Mac Beach Studio is not responsible for damage caused by:

  • Improper installation
  • Incorrect fasteners or anchors
  • Unsuitable wall conditions
  • Mishandling
  • Impact
  • Moisture
  • Excessive heat
  • Direct exposure to damaging environmental conditions
  • Alteration of the artwork or mounting hardware

Professional installation is recommended where the customer is uncertain about mounting conditions or where the artwork is large or heavy.

Website use

You may use this website only for lawful personal or business purposes related to reviewing, purchasing, or inquiring about Mac Beach Studio products and services.

You may not:

  • Misuse the website
  • Attempt unauthorized access
  • Interfere with website security or operation
  • Introduce malicious code
  • Scrape or systematically extract website content
  • Submit false information
  • Use the website for fraud
  • Impersonate another person
  • Violate another party’s rights

Mac Beach Studio may suspend or restrict access where misuse is suspected.

Intellectual property

All photographs, artworks, product images, text, graphics, logos, layouts, videos, designs, and other original content on the website are owned by or licensed to Mac Beach Studio and are protected by applicable intellectual-property laws.

No content may be copied, reproduced, distributed, modified, displayed, published, licensed, sold, used to train or operate an artificial-intelligence system, or exploited commercially without prior written permission.

Purchasing an artwork grants ownership of the physical object only. It does not grant permission to reproduce, publish, license, tokenize, commercially display, distribute, or create derivative works from the image.

Third-party services

The website may rely on Shopify, payment processors, fulfillment providers, shipping carriers, analytics services, and other third parties.

Mac Beach Studio is not responsible for outages, delays, errors, or acts of third parties outside its reasonable control, except as required by applicable law.

Third-party services may be governed by their own terms and privacy policies.

Disclaimer of warranties

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis.

Mac Beach Studio does not warrant that the website will always be uninterrupted, error-free, secure, or free from harmful components.

Any warranties that cannot legally be excluded remain unaffected.

Limitation of liability

To the fullest extent permitted by law, Mac Beach Studio will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or purchase, delivery, installation, display, or use of a product.

Where liability cannot legally be excluded, Mac Beach Studio’s aggregate liability relating to a product or order will not exceed the amount paid for that product or order, except where applicable law requires otherwise.

This limitation does not apply where liability cannot lawfully be limited or excluded.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Mac Beach Studio harmless from claims, losses, liabilities, and reasonable expenses arising from your unlawful misuse of the website, violation of these Terms, infringement of another party’s rights, or improper installation or handling of an artwork.

Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any dispute will be subject to the jurisdiction of courts located in New York, except where applicable consumer law grants the customer the right to bring a claim elsewhere.

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect.

Changes to these Terms

Mac Beach Studio may revise these Terms to reflect changes in products, operations, website features, service providers, or legal requirements.

The revised Terms will be posted on the website with an updated revision date. Changes apply prospectively unless applicable law requires otherwise.
